1. Acceptance of Terms

By accessing or using Kodals ("the Service"), operated by Kodals ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Kodals provides uptime monitoring, status page hosting, incident management, and alerting services. We offer free and paid subscription plans with varying feature limits.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account. You must be at least 16 years old to use the Service.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use the Service to monitor websites you do not own or have permission to monitor
• Resell or redistribute the Service without our written consent
• Use automated means to create accounts or submit requests beyond normal usage

5. Paid Plans & Billing

Paid subscriptions are billed in advance on a monthly basis. You may cancel at any time; access continues until the end of the billing period. Refunds are not provided for partial months. We reserve the right to change pricing with 30 days' notice.

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described therein.

7. Uptime & Availability

We strive for high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranties of any kind. We are not liable for damages arising from service interruptions or inaccurate monitoring results.

8. Intellectual Property

All content, code, and branding of the Service are owned by Kodals. Your data remains yours. By using the Service, you grant us a limited license to process your data solely to provide the Service.

9. Termination

We may suspend or terminate your account for violation of these Terms with reasonable notice. You may delete your account at any time from Settings. Upon termination, your data will be deleted within 30 days, except where retention is required by law.

10. Limitation of Liability

To the maximum extent permitted by law, Kodals shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation first.
